WALUAA SURF AND YOGA RETREAT, SANTA CATALINA PANAMA

Waiver & Media Release

In consideration of being allowed to participate in any way in Waluaa related events and activities, which include but are not limited to; surfing, yoga, SUP boarding, SUP Yoga, kayaking, diving, snorkeling, bike-riding, horse-riding, massage, transport to and from retreat activities, lodging and meals, and other land and water sports and activities, the customer, appreciates, and agrees that:

1.    The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,

2.    I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,

3.    I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest retreat official immediately; and,

4.   In the event that I should require medical care or treatment, I agree to be financially responsible for any costs or damages incurred as a result of such treatment. I am aware and understand that I should carry my own comprehensive travel insurance; and,

5.   In the event that any damage to retreat equipment or retreat facilities occurs as a result of my actions, accidental or otherwise, I acknowledge and agree to be held liable for any and all costs associated with their repair or replacement, this includes dings and damage to surf boards, and,

6. COVID-19: I recognize that Waluaa and their accommodation, transport and tour suppliers have reasonable preventative measures in place aimed to reduce the spread of COVID-19. However, given the nature of the virus, I understand there is inherent risk of becoming infected with COVID-19 by virtue of taking part in the retreat. I acknowledge and assume the risk of becoming infected with COVID-19 by participating in the retreat and acknowledge that such exposure or infection may result in personal injury, illness, disability, and death to myself or a family member. If I display symptoms or I am feeling unwell, I agree to self-isolate. If I have booked a shared room, I agree to upgrade to a private room at the retreat location if available, or at an alternative accommodation at my own cost.

7.    I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Waluaa, their officers, officials, agents, and/or employees, contractors, volunteers, other participants, and if applicable, owners and lessors of premises used to conduct the retreat activities (“RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

8. Media; As part of the retreat service, Waluaa may take photos and videos of you and provide these to you at the end of your stay. You grant Waluaa the option to use these photos and videos for marketing purposes.
